A question about trademark/copyright stuff?

Say for example no one in my small town had ever seen or used a spork (plastic spoon/fork) However they have in New York. If I create and sell sporks in my hometown and maybe modify them so that it holds salt or pepper too could i get sued by the people that came up with sporks in the first place?
