How can this be possible?

I am a moderator in a channel in justin tv, and today a user(not a mod) was being very rude so i gave him a 10 minute time out, but then the user was still talking even though i already gave him the timeout so then i gave him a BAN this time and he still was able to talk! why ?? how could he unban himself?
